1. INTRODUCTION
1.1. These Encore Rewards Terms and Conditions, (the "Terms") govern the Encore Rewards Program.
1.2. For the purposes of the Program, any reference to "Chances" includes any Community Gaming Centre in British Columbia.
1.3. British Columbia Lottery Corporation ("BCLC") may amend or alter these Terms at any time at its sole discretion. The current Terms may be accessed on the premises of any BC Casino or Community Gaming Centre or online at CasinosBC.com.
2. DEFINITIONS
2.1. “Base Points” means Points earned through eligible play that are redeemable for free play, and does not include Points given to Program Members through promotions.
2.2. “Bonus Points” or “Bonus Prize” means additional Points other than Base Points that may be rewarded to a Program Member depending on their Encore Rewards Status.
2.3. “Base Points Accelerator” means additional Base Points that may be awarded to a Program Member while playing on eligible slot machines, electronic table games or from qualified food and beverage purchases. Table games, alcohol purchases, tax and Online Games are not eligible for the Base Points Accelerator.
2.4. “Encore Rewards” means the Points rewarded to a Program Member by BCLC.
2.5. “Encore Rewards Account” means the account a Program Member has due to their membership in the Program.
2.6. “Encore Rewards Card” or “Encore Card” or “Card” means the card that is linked to the Program Member’s Encore Rewards account and issued to a Program Member after the Program application has been completed online at CasinosBC.com, online at PlayNow.com, or in-person by the applicant and verified at a BC Casino or Community Gaming Centre by showing government issued photo identification.
2.7. “Encore Rewards Program” or “Program” means the membership and tiered bonus reward program established by BCLC for Program Members.
2.8. “Encore Rewards Status” means the Diamond, Double Diamond, Triple Diamond or Elite status of a Program Member’s membership in the Program which is determined by the amount of play the Program Member has according to these Terms.
2.9. “Gaming Day” means the 24-hour period from:
2.9.1. 7:00:00 am PT on one day to 6:59:59 am PT the following day, for play at BC Casinos or Community Gaming Centres; and
2.9.2. 4:09:00 am PT on one day to 4:08:59 am PT the following day, for Online Games.
2.10. “Inactive” means an Encore Rewards account that does not register a transaction for twenty-four (24) continuous months.
2.11. “Ineligible Activities” means those activities that are ineligible towards earning and redeeming Points, and includes:
2.11.1. advantage play, where bets are hedged to cover losses;
2.11.1.2.11.2. Ineligible Free Play Use; and
2.11.3. any other activity or activities that BCLC determines, at its discretion, are ineligible towards earning Points.
2.12. “Ineligible Free Play Use” means converting free play to cash by leveraging advantage play or by any other activity or activities that BCLC determines, at its discretion, is ineligible use of free play.
2.13. “Online Encore Account” means the Program Member’s Encore Rewards Account information that is available through the Member Site (as defined in section 12.1).
2.14. “Online Games” means eSlot, eTable, Instants and Live Casino games on PlayNow.com.
2.14.1. For clarity, Online Games do not include Sports, Lottery, Bingo, ePoker, and Video Poker games on PlayNow.com.
2.15. “Points” mean points that are rewarded to a Program Member for slot, electronic table game and table game play at any BC Casino and Community Gaming Centre or for Online Games, as well as points given to players through promotions.
2.16. “Program Member” means a player who is eligible to sign up for the Program and has completed the requirements to participate in the Program as set out in these Terms.
2.17. “VSE” means BCLC’s voluntary self-exclusion program also known as Game Break.
2.18. “Membership Status Points” means the points that are awarded to a Program Member based on the amount of play at BC Casino and Community Gaming Centre as well as Online Games. These points are not redeemable for free play and only determine a Program Member’s Encore Rewards Status.
2.19. “Status Points Accelerator” means Bonus Points that may be awarded towards the Membership Status Points of a Program Member.
2.19.1. Status Points Accelerators cannot be earned through Online Games.
3. MEMBERSHIP
3.1. Participation in any aspect of the Program constitutes acceptance of the Terms in effect at the time of a player’s participation in the Program.
3.2. Participation in the Program is free and is granted and maintained at BCLC's discretion.
3.3. To become a Program Member, you must:
3.3.1. complete the Encore Rewards application, in full, either:
a. on PlayNow.com if you already have an active PlayNow.com account;
b. online at CasinosBC.com; or
c. in person at any BC Casino or Community Gaming Centre;
3.3.2. be at least 19 years of age; and either:
a. present government-issued photo identification in person at any BC Casino or Community Gaming Centre; or
b. verify your identity:
(i) through an active PlayNow.com account by signing up for the Program when you log into your PlayNow.com account; or
(ii) contacting BCLC’s Customer Support Centre to link your Encore Rewards account with your active PlayNow.com account.
3.4. Program Members are eligible to earn Encore Rewards by playing Online Games effective February 7, 2021, and are eligible to redeem Encore Rewards on Online Games effective May 11, 2022.
3.5. Membership in the Program is only available to natural persons. Organizations and institutions are not eligible for membership in the Program.
3.6. Program Members are limited to one Encore Rewards Account per Program Member.
3.7. If more than one Encore Rewards Account is found to belong to the same Program Member, BCLC reserves the right to merge duplicate Encore Rewards Accounts and consolidate all Points into the consolidated Encore Rewards Account.
3.7.1. The Encore Rewards Accounts will be merged with the Encore Rewards Account that has the most recent transactions; and
3.7.2. When Encore Rewards Accounts are merged, BCLC will advise the member that the Encore Rewards Accounts have been merged and that the Point(s) have been consolidated, except that a VSE or barred Program Member will be advised accordingly upon the expiry of their VSE or barring period.
3.8. Unless otherwise authorized or exempted by BCLC corporate policies, BCLC employees or BCLC contractors are not eligible to become a Program Member.
3.9. BCLC gaming service providers’ employees may participate in the Program.
3.10. Individuals who enroll or are enrolled in VSE, or are, suspended or banned from a BC Casino or Community Gaming Centre, are not eligible to become Program Members.
3.11. All Program benefits and rewards are subject to availability.
3.12. Membership in the Program and its benefits are non-transferable.
3.13. Each Program Member is subject to and must abide by these Terms.
4. VSE
4.1. The Encore Rewards Account of Program Members who enroll in VSE will be suspended on PlayNow.com and in BC Casinos or Community Gaming Centres.
4.2. Program Members who wish for their Points to be paid out upon their enrollment in VSE must contact:
4.2.1. BCLC, either through:
a. PlayNow.com;
b. the live chat function for BCLC’s GameBreak program or by calling BCLC’s GameBreak program; or
c. by attending a BCLC corporate office in person;
or
4.2.2. in person at the customer services desk of a BC Casino or Community Gaming Centre.
4.3. For the purposes of paying out Points following an Encore Rewards Account suspension for VSE enrollment:
4.3.1. if the request is made to BCLC through the methods set out in section 4.2.1., Points will be paid out in the form of a cheque mailed to your most recent address in your Encore Rewards Account, provided BCLC will only pay out a Program Member’s Points if the value of the pay out is five (5) dollars or above;
4.3.2. if the request is made at a BC Casino or Community Gaming Centre, the payout will be in cash. However, BC Casinos or Community Gaming Centres are not able to pay out any Points awarded at another BC Casino or Community Gaming Centre.
4.4. Program Members who wish to reinstate their suspended Encore Rewards Account after their VSE enrollment has expired must first satisfy the VSE reinstatement process and complete a new Encore Rewards application.
5. PRIVACY
5.1. Under this Section 5, reference to “you” or “your” means the individual who is reading these Terms, including Program Members.
5.2. Personal information related to your Encore Rewards Account will be collected in accordance with the Freedom of Information and Protection of Privacy Act, British Columbia, and will be used, accessed, disclosed and stored by BCLC, or a BC Casino or Community Gaming Centre, and their respective service providers both inside and outside of Canada:
5.2.1. to administer the Program, which includes distributing information about your Encore Rewards account;
5.2.2. to administer and communicate with you about your Encore Rewards account;
5.2.3. subject to your consent, to distribute relevant content, offers and promotional communications relating to BCLC’s and the BC Casino or Community Gaming Centres’ products and services to you;
5.2.4. to administer contests and promotions;
5.2.5. to administer responsible gaming programs, if you enroll in such program;
5.2.6. for research, survey and statistical purposes;
5.2.7. to customize the content and delivery of products, services and marketing;
5.2.8. to expedite enrolment in other products and services provided by BCLC and BC Casino or Community Gaming Centres that may be of interest to you;
5.2.9. to maintain the security of CasinosBC.com and for investigative purposes; and
5.2.10. to enforce agreements, to comply with applicable laws and legal processes, including providing information as required by regulators, law enforcement, public health authorities or other agencies.
5.3. By accepting these Terms, you agree that BCLC, or a BC Casino or Community Gaming Centre, and their respective service providers may use, access, disclose and store your personal information both inside and outside Canada for the above purposes.
5.4. You must keep your personal information up to date and must notify BCLC or a BC Casino or Community Gaming Centre of any change(s). You may change some of your personal information online, once you have registered for an Online Encore Account. Some changes may also be made by contacting BCLC’s Customer Support Centre or a BC Casino or Community Gaming Centre. All other changes must be made in person at a BC Casino or Community Gaming Centre and you must present government-issued photo identification when the change is requested.
5.5. If you elect to provide shared contact information, such as an email address that is accessible by yourself and another individual(s), personal information, including account balances and point activity, may be sent to this address. In some cases, BCLC or a BC Casino or Community Gaming Centre may not be able to send all communications to you. By providing shared contact information, you consent to BCLC disclosing your personal information to the other users that share the contact information.
5.6. When you apply for an Encore Rewards Account, you will be able to indicate your communication preferences. You may amend your preferences if you sign up for an Online Encore Account, by contacting BCLC or in person at a BC Casino or Community Gaming Centre. Regardless of your promotional communication preferences, BCLC or a BC Casino or Community Gaming Centre may still need to send important non-promotional information to you about your account.
5.7. If you have any questions about the collection or use of your personal information, please contact the BC Casino or Community Gaming Centre you received the communication from or BCLC’s Customer Support Centre at 74 West Seymour Street, Kamloops, BC, V2C 1E2, Telephone 1-866-815-0222 or bclc.com.
6. MEMBERSHIP CARDS
6.1. All Cards remain the property of BCLC.
6.2. A Program Member may not have more than three (3) valid Cards inserted in gaming devices at any time.
6.3. A Program Member may only use the Encore Rewards Account and Cards issued to that Program Member. Program Members must not give their Encore Rewards Account information or Card to another person.
6.4. Program Members must immediately report lost, stolen, or malfunctioning Card to BCLC or a BC Casino or Community Gaming Centre.
6.5. BCLC and its service providers are not responsible for any loss caused by the misuse of an Encore Rewards Account or Card.
6.6. BCLC may replace a lost, stolen or damaged Card in its discretion upon presentation of government issued photo identification in person at a BC Casino or Community Gaming Centre. BCLC reserves the right to charge a fee for replacement or duplicate Cards or to terminate a Program Member’s membership in the Program if BCLC decides a Program Member has claimed an excessive number of lost, damaged and/or stolen cards.
7. ENCORE REWARD BENEFITS
7.1. Points can be earned and redeemed for eligible games at any BC Casino or Community Gaming Centre and for Online Games on PlayNow.com. Further information about earning and redeeming Points can be obtained on the premises of a BC Casino or Community Gaming Centre, from the BCLC Customer Support Centre, or online at CasinosBC.com.
7.2. Program Members may earn Points and may receive Bonus Prizes at any BC Casino or Community Gaming Centre:
7.2.1. while your Card is inserted into the card reader or by entering the phone number and PIN associated to your Encore Rewards Account at eligible slots or electronic table games; or
7.2.2. by providing your Card to the appropriate tables game dealer or dealer supervisor at eligible table games.
7.3. Program Members may earn Points and may receive Bonus Prizes when playing eligible Online Games, provided they have linked their Encore Rewards account to their PlayNow.com account. Program Members may only link their own Encore Rewards account to their own PlayNow.com. Program Members cannot earn Points through another person’s PlayNow.com account.
7.3.1. Program Members are solely responsible for ensuring the correct Encore Rewards account number is linked to their PlayNow.com account.
7.3.2. Only Program Members who are residents of British Columbia may earn and redeem Points when playing Online Games.
7.3.3. Points earned on PlayNow.com can take up to 48 hours to load into a Program Member’s Encore Rewards Account.
7.4. Program Members cannot earn Points while playing poker or participating in a tournament of any kind at any BC Casino or Community Gaming Centre.
7.5. Program Members can earn Points on food and beverage purchases at participating food and beverage venues at BC Casinos or Community Gaming Centres. To be eligible for benefits, it is a Program Member’s responsibility to ensure that their Card is provided to the food and beverage staff, or, for gaming, inserted properly into the slot machine or eligible electronic table game, and remains in the machine while they play or, for table games, is given to the appropriate table game dealer or dealer supervisor. For Online Games, the Program Member’s Encore Rewards number as well as any applicable promotional codes must be entered in their PlayNow.com account.
7.5.1. On table games, it is the Program Member’s responsibility to ensure that a dealer supervisor is aware of their play and has been provided with the Program Member’s Card.
7.5.2. Points earned on food and beverage purchases can take up to 48 hours to load into the Program Member’s Encore Rewards Account.
7.6. Points are redeemable for free play, or other prizes as determined by BCLC from time-to-time.
7.7. Points are awarded subject to system availability.
7.8. The amount of Points a Program Member can earn on slots or electronic table games is based on the following factors:
7.8.1. The game played;
7.8.2. The amount wagered; and
7.8.3. The Program Member’s Encore Rewards Status at the time of play.
7.9. The amount of Points a Program Member can earn on table games is based on the following factors:
7.9.1. The table game played;
7.9.2. The average amount wagered;
7.9.3. The time played;
7.9.4. The number of hands played per hour; and
7.9.5. The Program Member’s Encore Rewards Status at the time of play.
7.10. The amount of Points a Program Member can earn on Online Games is based on the following factors:
7.10.1. The game played; and
7.10.2. The amount wagered.
7.11. The amount of Points a Program Member can earn for dining is 1 Point for every $1 spent on qualified food and beverage purchases.
7.11.1. Program Members do not earn Points on alcohol purchases.
7.11.2. Program Members do not earn Points on tax.
7.11.3. Qualified food and beverage purchases vary at each participating BC Casino and Community Gaming Centre. Program Members are responsible for confirming a purchase qualifies to earn Points before making the purchase.
7.11.4. If a Program Member forgets their Card, they can claim their unearned Points by presenting their dining receipt and their Card to Guest Services at the BC Casino and Community Gaming Centre location where they dined within 10 days of when those Points would have been earned.
7.12. BCLC reserves the right to change or restrict Point earnings or other awards on specific slot machines, table games, Online Games, other games and food and beverage purchases. It remains the Program Member’s responsibility to verify whether Points are earned on their play or purchases.
7.13. Promotions may be offered to Program Members from time to time, and may be subject to specific promotion conditions. Promotions may be subject to date and time restrictions.
7.14. Program Members must notify BCLC of any omissions or discrepancies in their Point balance within sixty days of earning, receiving or using the applicable Points. BCLC may require Program Members to provide documentation in support of any requested correction.
7.15. BCLC will not be liable for and may adjust or cancel a Program Member’s Points balance where Points have accrued due to malfunction, operator error, misrepresentation, fraud, misuse or any other reason BCLC deems valid.
7.15.1. In the instance of system error of Point transactions, adjustments will not be made to Encore Rewards Accounts where the difference (in favour of or against the Program Member) is less than one (1) dollar within a single Gaming Day.
7.16. Program Members must not engage in Ineligible Activities to earn or redeem Points. Notwithstanding the generality of section 7.15, BCLC will not be liable for and may adjust or cancel a Program Member’s Points balance or refuse to pay out or redeem Points where Points have accrued due to Ineligible Activities.
8. MEMBERSHIP STATUS
8.1. The Encore Rewards Program has four (4) Encore Rewards Status levels for earning Points– Single Diamond, Double Diamond, Triple Diamond and Elite. A Program Member’s Encore Rewards Status is determined by the Membership Status Points and Status Accelerator Points earned while playing eligible slot machines, electronic table games, table games, Online Games, or from qualified food and beverage purchases during a Status period (each a “Period”):
8.1.1. Single Diamond – 0 – 9,999 Membership Status Points
8.1.2. Double Diamond – 10,000 – 49,999 Membership Status Points
8.1.3. Triple Diamond – 50,000 – 149,999 Membership Status Points
8.1.4. Elite – 150,000+ Membership Status Points
8.2. Membership Status Points do not include Points given or credited to you as part of a promotion (such as point multipliers, Bonus Points, or promotional points).
8.3. A Period commences on September 1 and will end after a period of twelve (12) months, on August 31 of the following year. If a Program Member joins the Program other than on September 1, their first Period will commence from the date they became a Program Member until the following August 31. The Membership Status Points a Program Member earns during a Period qualifies that Program Member for their Membership Status from the date earned through August 31 of the following year. For example; if a Program Member reaches 10,000 Membership Status Points in November of 2023, they will remain at Double Diamond status until August 31, 2024. Evaluation by BCLC of the amount of Membership Status Points required for Encore Rewards Status upgrades and downgrades occur at the end of each Period. Encore Rewards Accounts that did not maintain their Membership Status Points are eligible for downgrade in status and will be processed each September, following a Period. Once processed, your account will reflect your new Membership Status.
8.4. Throughout a Period, upgrades to higher Encore Reward Statuses are processed on a daily basis. When a Program Member’s Encore Reward Status is upgraded during a Period, a new Period will not commence.
8.5. Base Point Accelerators are earned in addition to Base Points, as a percentage of Base Points earned during play. Base Point Accelerators are not applied to play on Online Games. The percentage Base Point Accelerator is based on a Program Member’s Encore Rewards Status level:
8.5.1. Double Diamond – 5% bonus
8.5.2. Triple Diamond – 10% bonus
8.5.3. Elite – 15% bonus
8.6. Status Points Accelerators are awarded based on a Program Member’s Encore Rewards Status level at the time they are earned. Status Points Accelerators cannot be earned or applied retroactively.
8.7. The benefits Program Members are eligible for are based on their Encore Rewards Status as outlined on CasinosBC.com and in the Welcome Package available at any BC Casino or Community Gaming Centre, as may be amended from time to time by BCLC.
9. REDEEMING POINTS
9.1. Redemption of Points is subject to system and BC Casino and Community Gaming Centre availability.
9.2. A deceased Program Member’s Points may be redeemed by the Executor or Administrator of the deceased’s estate upon presentation of either the will and death certificate or a letter from the estate’s lawyer confirming the recipient’s appointment as the estate’s Executor or Administrator (if payout is under $500) or a representation grant if the payment is $500 or over.
9.2.1. A representation grant for the purposes of section 9.2 of these Terms means either:
9.2.1.a A certified copy of the grant of probate, if the deceased had a will; or
9.2.1.b A certified copy of the grant of administration of the estate of the deceased person, if the deceased did not have a will; and
9.2.2. BCLC will only pay out a deceased Program Member’s Points by cheque if the value of the pay out is five (5) dollars or above.
9.2.3. Government-issued photo identification that confirms the person making the request is the same person that is authorized to act on behalf of the estate in the will or representation grant.
9.3. Points will not be paid out in cash, except in accordance with these Terms, and at BCLC’s discretion.
9.4. A Personal Identification Number (“PIN”) and Card are required for a Program Member to redeem Points on slots or electronic table games, or at tables.
9.4.1. PIN set-up instructions and use requirements:
a. Program Members can set up a PIN by visiting a BC Casino or Community Gaming Centre with their government-issued photo identification; and
b. Once PIN is set up, the PIN can be updated under a Program Member’s profile in CasinosBC.com;
c. Program Members are solely responsible for any activity on their account when the account is accessed by their Card and PIN;
d. Program Members must keep their PIN confidential and secure; and
e. Program Members are responsible for reporting any unauthorized PIN changes to BCLC or BC Casino or Community Gaming Centre.
9.5. A PIN is not required to redeem Points on eligible Online Games on PlayNow.com, provided that the Program Member has linked their Encore Rewards account and their active PlayNow.com account.
9.6. Program Members must notify BCLC if they suspect unauthorized use of their Card of Encore Rewards Online Account.
9.7. Points can be redeemed for free play at a gaming device, such as slots or electronic table games, or at Guest Services at a BC Casino for table games. Points redeemed for table games will be issued as a free play voucher. Vouchers can only be used for table game play and the entire value of the voucher must be used in a single bet. Vouchers expire at the end of the Gaming Day on which they are issued. Unused vouchers or portions of vouchers are void and will not be returned to your Points balance.
9.8. The minimum Points redemption amounts are:
9.8.1. $5.00 or 1000 in Points for slots or electronic table games; or
9.8.2. $10.00 or 2000 in Points for table games.
9.9. After the minimum Points redemption amount is met, Program Members may be able to redeem Points in increments. Availability of incremental redemption is dependant on the game for which the Points are redeemed.
9.10. For slot machines and electronic table games, any Points that Program Members redeemed but did not use are automatically returned to their Points balance when their Card is removed.
9.11. Points can be redeemed for free play on eligible Online Games on PlayNow.com. Points redeemed on PlayNow.com will be redeemed as a free play token.
9.11.1. Live Casino games and eTable games are Online Games that are not eligible for redeeming Points on PlayNow.com.
9.11.2. Encore Rewards Online Account must be linked and verified with their PlayNow.com account.
9.11.3. Minimum redemption amount on PlayNow.com is $5.00 or 1000 in Points.
9.11.4. One free play token reflecting the amount of Points redeemed is awarded when Points are redeemed on PlayNow.com.
9.11.5. Once the Points have been redeemed as a free play token in PlayNow.com, the free play token is valid for 90 days.
9.11.6. Once the Points have been redeemed on PlayNow.com as a free play token, it can only be used for playing eligible Online Games on PlayNow.com and cannot be reverted back to Points.
10. CANCELLATION OF POINTS
10.1. If another person uses a Program Member’s Card, the Program Member may have their Program membership either terminated or suspended at BCLC’s sole discretion and BCLC may cancel all Points or other rewards in their Encore Rewards Account.
10.2. BCLC will suspend or cancel a Program Member’s Points or other rewards if they have been barred, banned, or suspended.
10.3. In the event a Program Member’s Encore Rewards Account becomes Inactive, BCLC will cancel any Points and may terminate or deactivate that Program Member’s Encore Rewards Account.
10.4. Unused Points expire 365 days after they are earned, unless otherwise agreed to by BCLC.
10.4.1. Unused Points redeemed on PlayNow.com as a free play token(s) expire 90 days after they are redeemed on PlayNow.com, unless otherwise agreed to by BCLC.
10.5. Points and any other benefits cannot be reclaimed after cancellation, termination, closing or deactivation of a Program Member’s Encore Rewards Account.
10.6. Program Members may close their Encore Rewards Account at any time by:
10.6.1. Visiting a BC Casino or Community Gaming Centre and showing government-issued photo identification; or
10.6.2. Contacting Customer Support via phone or Live Chat and supplying government-issued photo identification.
10.7. Encore Rewards Accounts that have been closed in accordance with section 10.6 or closed due to being Inactive) can be reopened by visiting a BC Casino or any Community Gaming Centre with valid government-issued photo identification and completing a new registration form. Notwithstanding the foregoing, upon a request to reopen an Encore Rewards Account, BCLC reserves the right to reopen or refuse to reopen an Encore Rewards Account at its discretion.
11. MISUSE
11.1. BCLC reserves the right to revoke, suspend, terminate, or deny membership in the Program from any person, including Program Members, if they misuse their Card or their Encore Rewards Account, do not comply with or breach these Terms, or if BCLC decides that their actions are bringing the Program into disrepute.
11.2. BCLC reserves the right to cancel Points or other benefits obtained through misuse of a Card or Encore Rewards Account, or from a breach of these Terms.
12. ENCORE REWARDS MEMBER SITE
12.1. If a Program Member has a valid, active Encore Rewards Account, the Program Member has the option to view their Encore Rewards Account information including Point earning and redemption activities via a secure web-based member site available through CasinosBC.com ("Member Site"). Program Members may update their contact information, except their name, on the Member Site. All other changes must be made in person at a BC Casino or Community Gaming Centre or by contacting BCLC Customer Support.
12.1.1. A Program Member that has linked their Online Encore Account with their PlayNow.com account has the ability to view limited information around their Encore Rewards Account through their PlayNow.com account.
12.2. Any use of the Member Site is subject to these Terms and any other applicable terms and conditions.
12.3. A Program Member who has signed up for an Encore Rewards Account in person at a BC Casino or Community Gaming Centre must activate their Online Encore Account at CasinosBC.com. An Online Encore Account is automatically activated for Program Members who sign up for an Encore Rewards Account online on CasinosBC.com or on PlayNow.com.
12.4. Program Members are responsible for selecting a Password (“Password”) for their access to the Member Site. The Password must be kept confidential and secure.
12.5. Program Members are solely responsible for any activity on their Online Encore Account when it is accessed by using their Password.
12.6. Program Members must immediately notify BCLC if they notice any suspected unauthorized use of the Member Site, their Online Encore Account, or PlayNow.com.
12.7. If a Program Member registers for the Member Site, that Program Member authorizes BCLC to communicate with them about matters concerning their Encore Rewards Account, or to provide important information about new or existing account services available to them.
12.8. Information on a Program Member’s Encore Rewards Account and transactions available via the Member Site are:
12.8.1. Subject to data delays and may be based on information that is outdated at time of viewing; and
12.8.2. Updated on the basis of a Gaming Day.
12.9. Information on a Program Member’s Encore Rewards Account and transactions that are available on PlayNow.com are limited to:
12.9.1. Available Encore Rewards balance that can be redeemed on Online Games;
12.9.2. Recent redeemed Encore Rewards; and
12.9.3. A Program Member’s Encore Rewards Status.
12.10. BCLC does not guarantee the accuracy, quality or reliability of, nor will BCLC be held liable for any content on the Member Site, Online Encore Account, or on PlayNow.com.
12.11. Program Members may download or otherwise obtain material through any use of the Member Site at their own discretion and risk. Program Members acknowledge and agree that they will be solely responsible for any damage to their computer system and any loss of data that results from their use of the Member Site.
13. PLAYPLANNER
13.1. PlayPlanner is an optional budgeting tool available on slot machine and electronic table game (collectively, “Electronic Gaming Devices”) provided to Program Members and to promotional card holders on certain slot machines (“PlayPlanner”). PlayPlanner is not available for Online Games.
13.2. PlayPlanner provides reminders on the interactive touch screen at Electronic Gaming Devices with respect to time and money limits that a Program Member has set using PlayPlanner.
13.3. Use of PlayPlanner by a Program Member is subject to these Terms.
13.4. BCLC reserves the right at its sole discretion to modify or cancel PlayPlanner including these Terms without notice.
14. HOW TO USE PLAYPLANNER
14.1. Program Members can use PlayPlanner by inserting their Card in an Electronic Gaming Device and selecting the option to use PlayPlanner. Promotional card holders can use PlayPlanner by inserting their promotional card in an Electronic Gaming Device and selecting the option to use PlayPlanner.
14.2. A player who elects to use PlayPlanner will be prompted to set limits as follows:
14.2.1. The amount of time which the player wants to play Electronic Gaming Devices in the current calendar day (“Time Limit”) and/or
14.2.2. The amount of money the player want to play Electronic Gaming Devices in the current calendar day (“Money Limit”)
(Time Limit and Money Limit collectively referred to as (“Limits”)).
14.3. The amount of money selected for a Money Limit is the approximate net-loss on Electronic Gaming Devices played by that player in a calendar day.
14.4. A calendar day for the purposes of the Limits is from 12:00:00 a.m. PT on one day up until 11:59:59 p.m. the next day.
14.5. A Program Member’s Card must be properly inserted in any Electronic Gaming Device played in order for the PlayPlanner tool to function.
14.6. Reminders are scheduled to appear as the player reaches approximately 50%, 90%, 100%, 150% and 200% of the Limits.
14.7. PlayPlanner does not restrict Program Members from further play beyond the Limits. The reminders appear upon reaching 100% of a Limit and requires a player to tap OK to resume play. All other reminders are designed to appear temporarily without any steps required from a player to continue play.
14.8. PlayPlanner is designed to enable a player to decrease a Limit immediately. However, increases to a Limit require a 24 hour waiting period to take effect.
15. PLAYPLANNER LIMITATIONS OF LIABILITY
15.1. In offering PlayPlanner, BCLC and its service providers do not assume any responsibility to monitor a Program Member’s gaming activities.
15.2. PlayPlanner is offered “as is” without any express or implied representation, warranty or condition of any kind, including but not limited to any warranty or condition of fitness for any particular purpose. Without limiting the generality of the foregoing, no warranty is made that PlayPlanner will be error-free including without limitation errors with respect to lost, misdirected, delayed, or incorrect reminders.
15.3. In no event will BCLC or its related parties be liable for any damages (including direct, indirect, special, incidental, consequential, punitive, lost profits, lost savings, lost or corrupted data, or any other damages) arising out of or related to the use of PlayPlanner regardless of the legal theory upon which any claim for such damages is based, whether based on breach of warranty, contract, tort (including negligence), strict liability, or otherwise and even if advised of the possibility of any such damages.
16. GENERAL
16.1. These Terms replace all previous Encore Rewards Program Terms and Conditions.
16.2. All decisions regarding the interpretation of these Terms lie solely with BCLC whose decisions will be binding.
16.3. Neither BCLC nor any of its related parties or service providers shall be liable for any damages or loss of any kind whatsoever including, without limitation:
16.3.1. the use of or inability to use the Member Site;
16.3.2. any unauthorized access to or alteration to a Program Member’s name, Password or any other transmissions or data;
16.3.3. any statements or conduct of any individual who in any way uses, or is connected to the Member Site, Online Encore Account, or PlayNow.com;
16.3.4. the use or disclosure of a Program Member’s Encore Rewards Account information, including personal information, by a BC Casino or Community Gaming Centre, a service provider or contractor, or a subcontractor or service provider or any of these, including, without limitation, in communications from, or contests or promotions offered by service providers or a BC Casino or Community Gaming Centre;
16.3.5. any statements, conduct, actions or omissions, including, without limitation the negligence, breach of contract or any other wrongful act on the part of any party whatsoever, including, without limitation, BCLC or a related party;
16.3.6. any damages (including direct, indirect, special, incidental, consequential, punitive, lost profits, lost savings, lost or corrupted data, or any other damages) arising out of or related to the Encore Rewards Account, regardless of the legal theory upon which any claim for such damages is based, whether based on breach of warranty, contract, tort (including negligence), strict liability, or otherwise and even if advised of the possibility of any such damages; and
16.3.7. any other matter relating to the Encore Rewards Account or the Member Site.
16.4. All contests, promotions, prizes, giveaways and other Program benefits are governed by and subject to all applicable Rules and Regulations and Conditions, including these Terms.
16.5. BCLC may, in its sole and absolute discretion, modify, suspend or discontinue any portion of the Encore Rewards Program or the Member Site at any time without notice. Additionally, BCLC may modify the Rules and Regulations and Conditions, including these Terms, at any time without any prior notice.
16.6. If any provision of these Terms is found to be invalid, all other provisions shall remain in effect.
16.7. Any stated dollars amounts are in Canadian currency.
16.8. Unless stated otherwise or the context requires, references to plural include the singular, and vice versa. If a word or expression is defined in these Terms, other parts of speech and grammatical forms of the same word or expression have corresponding meanings.
16.9. These Terms shall be governed by the laws of British Columbia and the laws of Canada applicable in British Columbia. The Courts of British Columbia shall have sole jurisdiction to deal with matters governed by these Terms.
16.10. BCLC reserves the right to modify, suspend, or cancel this Program at any time, for any reason.
